For using the Switch Energy site.

Welcome to Switch Energy’s website (the “Site”). These Terms and Conditions (“Terms”) govern your use of the Site and the purchase of products from Switch Energy, a solar equipment distributor located in West Kelowna, British Columbia. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using the Site.
1. General Information
1.1. Company Information
Switch Energy is a solar equipment distributor based in West Kelowna, BC, Canada. We sell exclusively to approved customers, who may place orders through this Site, by phone, or via email.
1.2. Customer Eligibility
To purchase products from Switch Energy, Customers must first apply and be approved. Applications can be submitted online through our application page, by phone, or via email. Approval is at Switch Energy’s sole discretion and is based on criteria that include, but are not limited to, business type, creditworthiness, and location.
1.3. Account Revocation
Switch Energy reserves the right to revoke a Customer’s account approval at any time, at its sole discretion. This may occur due to non-compliance with these Terms, changes in business circumstances, failure to meet payment obligations, or any other reason deemed relevant by Switch Energy.
2. Account Registration and Approval Process
2.1. Application and Account Setup
Customers must complete an application to be considered for approval. During the application process, Customers are required to provide accurate and current information, including billing details. Once approved, Customers will receive account login credentials to access the online store.
2.2. Account Information Accuracy
Customers are responsible for ensuring that the information provided in their application remains accurate and up to date. Switch Energy is not liable for any issues arising from inaccurate account information.
3. Payment Terms
3.1. Net Terms Payment
Invoices will be sent to the billing details outlined in the distributor application or specified in the order request stage. Payment due dates will be specified on the the invoice, and payment can be made by Interac E-Transfer, credit card (subject to standard fees, as of Nov 18 2024 these are 2.25%), or bank transfer.
3.2. Late Payments
If payment is not received within the agreed-upon term, Switch Energy reserves the right to charge late fees and/or interest on overdue amounts. Failure to comply with payment terms may result in suspension or termination of the Customer’s account.
3.3. Payment Methods
Payment can only be made via net terms as per the invoicing arrangements. Other payment methods are not accepted unless agreed to in writing by Switch Energy.
4. Order Placement and Fulfillment
4.1. Placing Orders
Approved Customers may place orders through the online store, via email, or by phone. All orders are processed upon confirmation and are subject to product availability.
4.2. Order Confirmation and Changes
Once an order is placed, Customers will receive an order confirmation. Any changes to the order must be requested within 24 hours and are subject to approval by Switch Energy. Orders may ship within 24 hours, and cannot be cancelled or modified once shipped.
4.3. Shipping and Delivery
Shipping terms and delivery estimates will be provided at the time of order placement. Customers are responsible for any shipping fees, duties, or taxes.
5. Returns and Cancellations
5.1. Return Policy
- Return Merchandise Authorization (RMA): Prior to returning any product, you must request a Return Merchandise Authorization (RMA) from Switch Energy. Returns without an RMA will not be accepted.
- Return Shipping Costs: You are responsible for all shipping costs associated with returning products to Switch Energy, unless otherwise specified.
- Defective Items: If you believe an item is defective, please contact Switch Energy to arrange for inspection and possible replacement.
- Restocking Fee: A 20% restocking fee will be applied to all returns, except in cases of verified defects or warranty claims.
- Battery Warranty Requirements: For battery warranty claims, a battery shunt or monitor must have been in place to enable Switch Energy to analyze the issue effectively.
5.2. Order Cancellation
Orders can be canceled if the request is made within 24 hours of order placement. Cancellations after this period may be subject to fees. Orders may ship within 23 hours, once shipping the order cannot be modified or cancelled.
6. Limitation of Liability
Switch Energy will not be liable for any indirect, incidental, or consequential damages arising from the use of the Site, delays in delivery, or issues with products. Liability is limited to the amount paid by the Customer for the specific order in question.
7. Privacy Policy
Our Privacy Policy governs how we collect, use, and protect Customers’ personal information. By agreeing to these Terms, you also agree to our Privacy Policy.
8. Modifications to Terms
Switch Energy reserves the right to modify these Terms at any time. Changes will be posted on the Site, and continued use of the Site signifies acceptance of the updated Terms.
9. Superseding Agreements
These Terms and Conditions do not supersede or replace any existing agreements you may have with Switch Energy. In cases where discrepancies arise, the terms of your specific agreement with Switch Energy will take precedence. Please refer to your individual contract for more details on your rights and obligations.
10. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada.
